By making a booking (online or via WhatsApp/email), you confirm that you have read and accept these Terms & Conditions, including the Liability Waiver / Acceptance of Risk below.

1) Bookings & Payments

  • Reservations are considered pending approval until a deposit is received and the booking is confirmed by our team.
  • Prices are listed in USD unless otherwise noted and may change without prior notice until a deposit is made.
  • The remaining balance is due prior to the activity start time (cash/transfer/approved methods).
  • Packages, add-ons, and promotional rates are valid only for the dates and conditions stated at the time of booking.

2) Acceptance of Risk & Liability Waiver

Surfing, SUP, ocean activities, boat tours, ATV and outdoor tours involve inherent risks, including but not limited to changing weather/ocean conditions, physical exertion, equipment use, slips/falls, collisions, and marine/wildlife exposure. By booking and/or participating, you and all participants in your party:

  • Represent that you are physically fit to participate and will disclose relevant medical conditions or limitations to our staff before the activity.
  • Agree to follow all safety instructions and use provided equipment properly.
  • Voluntarily assume all inherent risks associated with the selected activity.
  • Release and hold harmless Nosara Surf & SUP, its owners, staff, guides, and contractors from liability for injury, loss, or damage arising from ordinary negligence to the fullest extent permitted by Costa Rican law.

If booking on behalf of minors, you confirm you are the parent/legal guardian and accept these terms and the Liability Waiver for them.

3) Participant Requirements

  • Minimum ages and skill requirements vary by activity; minors must be accompanied by a parent/guardian as specified by the activity.
  • Participants must inform staff of any medical conditions (e.g., recent injuries, allergies, pregnancy) that could affect participation.
  • We reserve the right to refuse participation to anyone under the influence of alcohol/drugs or whose behavior may endanger themselves or others.

4) Weather, Tides & Ocean Conditions

  • Times and locations may be adjusted for safety and optimal conditions (tides, swell, wind, lightning, visibility).
  • We may reschedule, relocate, shorten, or cancel an activity for safety reasons at our discretion.
  • If we cancel due to unsafe conditions and no reasonable alternative is available, deposits are refundable (see policy below).

5) Rescheduling & Cancellations

  • Please refer to our Cancellation & Refund Policy for timing windows and specific terms.
  • Late arrivals may result in shortened sessions to respect tides and schedules; no partial refunds apply.

6) Equipment Care & Damage

  • Surfboards, SUP boards, leashes, PFDs, rash guards and all gear must be used as instructed.
  • Participants are responsible for damages resulting from misuse, negligence, or failure to follow instructions.

7) Media, Privacy & Marketing

  • With your consent, we may capture photos/videos for your personal use and/or for our promotional content.
  • Personal data is processed only to manage bookings and communications according to our Privacy practices. For questions, contact us via WhatsApp or email.

8) Force Majeure

We are not liable for delays or cancellations caused by events beyond our reasonable control (e.g., severe weather, natural disasters, safety closures, government actions, strikes, utility outages).

9) Governing Law & Venue

These Terms & Conditions are governed by the laws of Costa Rica. Any dispute shall be submitted to the competent courts in Costa Rica, unless otherwise required by applicable consumer protection laws.
